1. Acceptance of Terms
By creating an account, accessing, or using the Shoot Manager mobile application (the “App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and Motion Beach LLC (“we”, “us”, or “our”).
2. Eligibility
You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement.
3. Account Responsibilities
You are responsible for: • Maintaining the confidentiality of your account credentials • All activities that occur under your account • Providing accurate and up-to-date account information • Notifying us immediately of any unauthorized use of your account
4. Acceptable Use
You agree not to use the App to create, upload, share, or distribute content that: • Is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable • Infringes on the intellectual property rights, privacy, or other rights of any third party • Contains sexually explicit material, graphic violence, or content depicting the exploitation of minors • Promotes discrimination, hatred, or violence against any individual or group • Contains malware, viruses, or any other harmful software or code • Is spam, unsolicited advertising, or promotional material • Impersonates any person or entity, or falsely misrepresents your affiliation
We reserve the right to remove any content that violates these Terms and to suspend or terminate accounts engaged in such behavior, at our sole discretion.
5. Collaboration and Shared Content
The App includes collaboration features that allow you to share projects with team members. When you enable sharing: • You are responsible for the content you create and share with your team • Content you share becomes visible to all members of your collaboration team • Other team members may interact with your shared content as permitted by the App’s functionality • You may report objectionable content created by others using the in-app reporting feature • You may block other users to prevent seeing their shared content
By sharing content through the collaboration features, you represent that you have the right to share such content and that it does not violate these Terms or any applicable laws.
6. Content Reporting and Moderation
We are committed to maintaining a safe and respectful environment. If you encounter content that you believe violates these Terms: • Use the “Report” feature available throughout the App to flag objectionable content • Provide a reason and, optionally, additional details to help us review • We will review reports and take appropriate action, which may include content removal, warnings, or account suspension
Additionally, you may block users whose content you find objectionable. Blocking a user will hide their shared content from your view.
7. Intellectual Property
You retain ownership of all content you create within the App. By using the App, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the service.
The App, including its design, code, features, and branding, is the intellectual property of Motion Beach LLC and is protected by applicable copyright and trademark laws.
8. Subscriptions and Payments
Certain features of the App require an active Pro subscription. Subscriptions are billed through your platform’s app store (Apple App Store or Google Play Store) and are subject to their respective terms and refund policies.
We reserve the right to modify subscription pricing with reasonable notice. Existing subscribers will be informed of any price changes before their next renewal period.
9. Termination
We may suspend or terminate your account at any time if you violate these Terms, including but not limited to sharing objectionable content or engaging in abusive behavior toward other users.
You may delete your account at any time through the App. Upon deletion, all your data will be permanently removed as described in our Privacy Policy.
10. Disclaimers and Limitation of Liability
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOTION BEACH LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.
11. Changes to These Terms
We may update these Terms from time to time. When we make changes, we will update the “Effective Date” at the top of this page. Continued use of the App after any modifications constitutes your acknowledgment and acceptance of the updated Terms.
